Modern Chess provides digital chess education products and services, including but not limited to online courses, video lectures, PGN files, downloadable materials, live sessions, and memberships.

All content provided through the Service is digital unless explicitly stated otherwise.

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information at all times.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized use of your account.

4. Purchases and Payments

Payments are processed by third-party payment providers. Modern Chess does not store or process full payment card details.

We reserve the right to refuse or cancel any order in cases of suspected fraud, pricing errors, technical issues, or unauthorized or unlawful transactions.

5. Digital Content, Access, and Refund Policy

All courses and products sold on Modern Chess are digital content delivered electronically and made available immediately after purchase, unless stated otherwise.

By completing a purchase, you expressly acknowledge and agree that:

• Access to the digital content begins immediately
• The digital content can be fully accessed, viewed, and downloaded upon purchase

Accordingly, the statutory right of withdrawal does not apply once access to digital content has been granted, in accordance with EU Directive 2011/83/EU, Article 16(m).

For this reason, all sales are final and non-refundable once access to digital content has been provided.

Refunds will not be granted for reasons including but not limited to lack of use, change of mind, perceived difficulty level, or dissatisfaction after access.

6. Availability, Errors, and Updates

We continuously update and improve our products and services. While we strive for accuracy, content descriptions, pricing, availability, or technical details may occasionally contain errors or inaccuracies.

We reserve the right to correct errors, update content, change prices, or modify offerings at any time without prior notice.

Chess improvement depends on individual effort and practice. We do not guarantee rating gains, tournament results, or specific performance outcomes.

To the maximum extent permitted by law, Modern Chess shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

These Terms are governed by and construed in accordance with the laws of Bulgaria, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bulgaria.
